How do you apply for Disability?

If you are unable to work due to a disability and need financial assistance, applying for Social Security Disability (SSD) or Supplemental Security Income (SSI) benefits could provide much-needed support. The process of applying for disability benefits may seem overwhelming, but with the right steps and preparation, you can increase your chances of a successful application. Here’s a simple guide on how to apply for disability.

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

Step 1: Determine Your Eligibility

Before you apply, it’s essential to understand the eligibility requirements for both SSDI and SSI:

  • SSDI: This program is for individuals who have worked and paid Social Security taxes for a certain number of years. The number of years you need depends on your age and the age at which you became disabled. SSDI is available to people who have a disability that prevents them from working for at least 12 months or is expected to result in death.
  • SSI: SSI is a needs-based program for individuals with limited income and resources. You do not need a work history to qualify for SSI, but you must meet strict income and asset limits. SSI is for those who have a disability that prevents work and meet financial criteria.

Both programs require proof that you have a severe disability that makes it impossible for you to engage in substantial gainful activity.

Step 2: Gather the Necessary Documents

To apply for disability benefits, you will need to provide various documents. These include:

  • Proof of Identity: A birth certificate, Social Security card, or government-issued ID.
  • Medical Records: Detailed records from your doctors, hospitals, or healthcare providers outlining your diagnosis, treatments, and how your condition affects your ability to work.
  • Work History: For SSDI applicants, provide details about your past jobs, including the type of work you did and the length of employment.
  • Income Information: For SSI applicants, you must provide proof of your financial status, such as bank statements, pay stubs, and information about any other income sources.

The more comprehensive and accurate your documentation, the smoother the application process will go.

Step 3: Complete the Application

There are three primary ways to apply for disability benefits:

  • Online Application: The easiest way to apply is through the Social Security Administration  (SSA)’s online portal at www.ssa.gov. This allows you to apply from the comfort of your home, anytime, and you can track the status of your claim.
  • Phone Application: If you prefer to apply over the phone, call the SSA at 1-800-772-1213. An SSA representative will guide you through the process.
  • In-Person Application: You can also apply in person at your local SSA office. You can find your nearest SSA office by visiting the SSA website or calling their hotline.

Step 4: Complete the Disability Report

In addition to the application, you’ll need to complete a Disability Report. This is an important part of your claim, where you will provide detailed information about:

  • Your condition: Describe how your disability affects your daily life, including your ability to work and perform routine activities.
  • Medical treatment: List all the healthcare providers you’ve seen, the treatments you’ve received, and how your condition has changed over time.
  • Work history: Provide detailed information about the jobs you’ve had and how your condition impacts your ability to perform those tasks.

The Disability Report helps the SSA understand your limitations and makes it easier for them to evaluate your claim.

Step 5: Wait for a Decision

Once your application and Disability Report are submitted, the SSA will review your case. This process typically takes a few months, though it can take longer depending on the complexity of your case.

The SSA will either approve or deny your claim. If approved, you will begin receiving disability benefits. If your application is denied, don’t be discouraged—you have the right to appeal the decision.

Step 6: Appeal If Denied

It’s common for disability applications to be denied at first. If this happens, you can:

  • Request Reconsideration: If your claim is denied, you can ask the SSA to review your case again. They will re-evaluate your medical evidence and make a new decision.
  • Request a Hearing: If reconsideration is denied, you can request a hearing before an Administrative Law Judge (ALJ). This is where you can present your case in person, which can significantly improve your chances of approval.
  • Appeals Council: If the ALJ denies your claim, you can ask for a review by the Appeals Council.
  • Federal Court: As a final step, you may appeal the decision in federal court if necessary.

Step 7: Consider Getting Help from a Disability Lawyer

While you can apply for disability benefits on your own, hiring a disability lawyer can improve your chances of success. A lawyer can help with:

  • Completing the application: Ensuring all information is accurate and complete.
  • Gathering evidence: Helping you collect the medical records and other documentation you need.
  • Navigating the appeals process: If your claim is denied, a lawyer can represent you during hearings and assist you with every step of the appeal.

Many lawyers work on a contingency fee basis, meaning you don’t pay unless you win your case. The SSA caps lawyer fees at 25% of your back pay, up to $6,000, so you won’t face unexpected costs.
